Cross border cooperation is much higher these days Monty. No-one wants other people's criminals on their doorsteps.

Having said that, the Daily Mail will no doubt be running headlines for free speech and freedom of the press over the coming weeks, interspersed with Editorials devoted to how Brexit meant Brexit precisely for this reason (don't even go there) and that plucky Britain won't be pushed around by johnny foreigner anymore. And it will somehow manage to pin the blame on Brussels bureaucrats.

I hope she rinses the f*ck out of them. And then her husband loses.

Well, the complaint is filed in Montgomery County because the co-defendant, blogger Webster G. Tarpley, lives there. It can be found here.. In reading this I would say Webster might in trouble, but the Mail made it clear they were quoting other sources. Both defendants published retractions after being contacted by Melania's lawyers - does this mitigate against damages?

I don't know lots about defamation law and much less about US law but a few thoughts:

1) re: justification, usually with defamation you can sue in any jurisdiction something was "published". That's a v wide definition and in the days of the internet especially so.

3) re: enforcement I guess it will hinge on how the DM is structured as a company, however being inexplicably one of the biggest news sites globally I'd be very surprised if it didn't have assets it the US to enforce against.

3) it's probably worth noting that the Donald has a spectacularly shit record at suing people.

Re the first 3) (what happened to 2)?) - she is suing the Mail Online. It can be accessed in Maryland but hard to determine the specific venue where it is published (though the website has a co.uk in it).

Hey, I know less still about maths!

As I say publish is an extremely wide definition when it comes to the internet. Essentially I think that if you can read it in America then it has been published in America.
