I'm clinging to the hope it's based on the "string of texts" as that surely cannot hold up in court.Lost Leopard Spot wrote: ↑Wed Aug 14, 2019 2:23 pmAbsolutely. If there are caveats, clauses or T&C's that make EFL approval essential to buying the club he's fxcked and we move on... My worry is that he got the injunction on the back of 'something', I'm just hoping that Anderson didn't do something stupid which will give the judge reason to extend the injunction... That might not be fatal to Burnden Leisure but it would spell the end of us I fear.Prufrock wrote: ↑Wed Aug 14, 2019 2:15 pmThat's assuming of course that the agreement for sale wasn't conditional on him getting approval, which if Bassini wasn't nuts you'd definitely assume it would be. From what we've heard so far it sounds like it was (or who cares about Shaun Harvey's text).
More importantly though. Tough. If he's right he should've got an injunction before it went into admin. It's far too late now. His remedy is to sue Ken.

Sadly I fear that the legal world won't give a shit about BWFC - and will be far more interested in the minutiae of the law and legal procedure....
The end result being a complex lengthy case, the enrichment of members of the legal profession and the liquidation of BWFC as a going concern...
I've got everything crossed, ready for 3pm

...anyway a mere thirty five minutes to wait for the whistle. Unless extra time is called.
Let's not go to penalties.

Re: Administration and recovery
Why can't they? Texts are as much a legal document as notes, or anything else that is typed... Stuff doesn't even need to be typed for it to have legal weight - verbal contracts have an equal weight in law if they are witnessed.DJBlu wrote: ↑Wed Aug 14, 2019 2:25 pmI'm clinging to the hope it's based on the "string of texts" as that surely cannot hold up in court.Lost Leopard Spot wrote: ↑Wed Aug 14, 2019 2:23 pmAbsolutely. Re: Administration and recovery
Apparently Paul Appleton has suggested via a statement referenced in court that an adjournment would not affect the sale to FV. Seems strange, surely that would be for the judge to decide, given the sale involves a company that is a subject of the LB/KA ownership dispute?

Does anybody know who Bassini's barrister is, by the way?

Just ten minutes to find out whether Bassini is as mad as a box of ferrets, or Anderson as stupid as a moron with Alzheimers...

Especially given that his statement last week suggested the future of the club was in doubt because of the injunction, causing players to withdraw their services.Lost Leopard Spot wrote: ↑Wed Aug 14, 2019 2:38 pmWeird! Re: Administration and recovery
From all the talk that's been reported it seems pretty clear there is some sort of condition relating to EFL approval and they're arguing over the construction. Whether a text is enough will depend on the wording I'd think.
But I hope FV/admins have been repped. Just because LB might be right isn't enough for an injunction stopping the takeover.

I think you're right. It's going to be 4 months of kids and a few free agents getting hammered until the next window.

Re: Administration and recovery
Will we make it that far? Who's running the club until Jan? No takeover and I suspect we'll be kicked out of the league (would love to know what was in the EFL lawyer statement).
That's why I'm fairly confident it'll get lifted.
