dropped the D and D charge

apparently the test was invalid, therefore breath sample was also invalid as the bloke does not speak English, his solicitor successfully argued that 'he didnt know what to do'

how the f uck this goes I dont know

Dunno if I mentioned it but about two months back I was happily ensconced in my flat watching Stargate on DVD (a criminal offence in it's own right you might think) when I heard a massive crash outside my window, now I knew that my car was the only one there at the time, so I jumped up and legged it outside to see my next door neighbour (some Polish chap) in his car driving over and over and over into the back of mine at about 10mph.

Not far off geographically, but light years away ethnically and linguistically. :wink: I'm still puzzled by an inability to speak English being an acceptable excuse for being five times over the limit.

and given the amount of Poles in Preston it was a fair guess.

erm i dunno the intricacies of the law, i was too busy tutting and huffing when the cop told me what was going on.

i guess its cos he 'wasnt aware' that he was providing sample somehow invalidates said sample, but i dunno

It's a criminal offence for an English speaking person to refuse a breathtest anyway....


The language thing is a joke... anyone in the civilised world knows what it means when a police officer asks you to breath into a little black device at the roadside.

Surely, PB, it would be a criminal offence for anyone to refuse to take the test in England regardless of language spoken. You cannot have laws that specifically target English speakers but let foreigners off - that would be discrimination. Obviously now, foreigners are safer to take take the test and then claim not to understand - which is dumb. The whole thing makes no sense to me.
