Five teens accused of gang rape see the case against them dropped

FIVE teenage boys accused of gang raping a girl have had the case against them dropped.
Prosecutors yesterday revealed they were not taking action against the youths after closely examining the evidence.
A Crown Prosecution Service (CPS) spokesman said: “The Code for Crown Prosecutors — the guidance that all CPS lawyers follow — requires that, for a case to go ahead, there must be a realistic prospect of conviction.
“We have continuously reviewed this file and — in light of additional evidence recently presented to us — the CPS has concluded that there no longer exists a realistic prospect of conviction.
“We have therefore formally decided to discontinue the case.
“The victim has been informed of our decision and we have offered her a meeting to explain our decision.”
The five — who cannot be identified for legal reasons — were aged 13, 17 and three were aged 16.
They were due to appear in court yesterday, when the CPS revealed the case against them had been discontinued.
They were arrested in September after a 15-year-old girl told police she had been attacked on a bench in Queens Park.
Following the report, police placed a cordon around the scene of the alleged attack and removed the bench for tests.
At an earlier court hearing, it was claimed the girl had been socialising with friends in Victoria Square and later walked to Moor Lane Bus Station where she met five boys in their mid-teens.
It is believed she knew the boys, although she was not friends with them.
It was then claimed the group walked together to Queens Park where the boys allegedly turned on the girl and raped her on one of the benches.
The girl was later taken to the St Mary’s Sexual Assault Referral Centre in Manchester for treatment and was video interviewed by detectives.
The Bolton News understands a 45-second clip of the alleged incident on a mobile phone was among the evidence examined.
