I just added another 'yes'. Hobo should probably move to Texas where it is legal to shoot anyone on your property after dark. This includes lost German tourists asking for directions. Provocation is not an excuse for killing someone, though it may reduce the crime and mitigate the sentence.

The quote is from the msn comments on the story (one of the less extreme it has to be said)

Proving now't, merely pointing the finger at Social engineering failiures of the liberal/Socialists

The fact the law is an ass that should protect the good and innocent and punish the bad and wrong do'ers, protection for vile creatures like the corpse in this story should be a non starter.

I would consider myself as a wishy washy liberal on most things but I found myself agreeing with some of Hobo's venom on this. I've worked on a few rough council estates in my time and one or two of them were bad places to be after dark because of the activites of groups of dead legs.

This chap over reacted undoubtedly but only as a result of extreme provocation. I wonder if any of the dead blokes mates were charged for criminal damage after putting this poor fellas windows in? I don't know what the minimum term is for manslaughter but I think this case warrants it.

So a bloke pisses through someone's letter box and its fair do's that he's stabbed to death.

Whats the fair penalty for someone who prangs your car when drunk then?

Pop round his house and rape his wife and 5 year old daughter? Or perhaps just give him a good beating and make sure there is some brain damage!

Here you go Harry. In England and Wales manslaughter has a "discretionary" life sentence, as opposed to the mandatory one for murder. This means the judge's discretion is used. He could impose any sentence at all, from an unconditional discharge, which means a conviction is recorded but no punishment given, right up to life imprisonment, or even a fine.

No it isn't. Granted there was extreme provocation, which is why the charge was manslaughter not murder. Seems to me that a custodial sentence was required, else it would be open season on all kinds of things. I have no opinion whether five years was just right or not, but he should not have got a complete discharge.
