So I'm looking to write a letter of resignation. Just wondering with my 3 months notice period would my last day be 1st November? (Or 31st October as 1st is a Saturday). I realise this may be a stupid question.

In your case, if you chose to, you can write the "31st" ... & there you have it. You could write "the 1st, with my final day of attendance being the 31st". If that is accepted then, in the unlikely event of something terrible occurring on the 1st, yu woud still be an employee & so pension / death in service etc. still apply.
They'd have every right to say "no, make the resignation date the 31st.".
Not advocating mass-murder as an entirely positive experience, of course, but it had its moments.

Is this a fresh story ? I recall it happening previously.

A contractual requirement to work 3 months notice doesn't prevent you submitting 4 months notice. It's just the minimum that is contractually obliged. They do have the option to suggest an earlier date but that can't then impact on matters which are contractually obliged, that you were happy to meet, but they chose to come inside.
Nor does it prevent you asking to be released earlier ... but they can deny you that.
However, if you pretended that "m****r f****r" are 'just words' they'd be quite entitled to terminate you immediately.
How long have your worked for them ... & have you checked out the bonus details for leavers ?

Time your notice to whatever date you want. I waited to hand my notice in to time it with the date I wanted to leave and gave them the exact number of days notice. I could have given them more than twice the notice as I knew months before I was moving here, but between HR being a bunch of no nowt eejits and my boss being a knob, I wasn't risking any shenanigans from them.Beefheart wrote:That's alright then. Just found the bonus details. Not eligible if you are under notice at the date of payment. Piss. There's no way I'm staying that long, maybe they won't notice and I'll still get it.

Yeah not really. I'll at least have a nice chunk of holiday pay to take with me.

Hmm... check. They changed the law a while back on the rules about paying you in lieu of your holiday, basically to stop shops forcing their staff not to take holiday but to just give them the money extra. I think they still can for stuff like contract endings, but I don't think they have to. I'd check.

Was that the same legislation that said if an employee is paid primarily on commission then their holidays have to be paid at an average daily rate including commission rather than basic salary? I had a client recently who was rather annoyed by that.

Not sure. I have a vague memory of the commission thing being an EU decided case rather than legislation. The not getting holiday pay thing I heard about not from studying but from the in-laws who were having to rejig all their rotas and staff stuff because they couldn't pay staff in lieu.
