Oooh, I could just do with a nice head massage right now, neck and shoulders too. Jealous. Not sure the PE depts. budget would stretch that far though.

Its interesting that in most professions, ignorance is not a defence.
So, for example, were I to accidentally give somebody food poisoning, I could face a custodial sentence. If my accountant did my taxes wrong, they would face fines and prosecution, as, again, ignorance is not a defence.
Are you saying those kinds of laws should be scrapped? Or are you saying that bankers should have a separate code of conduct to just about every other profession? Perhaps we could call it "the rule for 1"?

Those two examples you have given would involve falling below generally accepted professional standards.
The problem in banking was that the generally accepted practices were fundamentally flawed... but nobody really knew. It is obviously a major problem and a big challenge to sort this out... but it does not to me seem like a recipe for criminal liability. Think of it as doctors administering drugs that had an unknown side-effect years down the line. If the professional body of opinion said that prescribing it at the time was the best thing to do, on the basis of the evidence available, they would not, of course, be found to be professionally negligent (or worse).
